When passing data on to our processors listed in the section Who processes your personal data and to whom do we pass it on?, we may also transfer your data to third countries outside the European Economic Area that do not ensure an adequate level of personal data protection. We will make any such transfer only if the processor concerned undertakes to comply with the standard contractual clauses issued by the European Commission and available at http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2004:385:0074:0084:EN:PDF
What rights do you have when your personal data are processed?
You have a number of rights in relation to your personal data. These are the right of access, rectification, erasure, restriction of processing, portability, objection and lodging a complaint.
Just as we have our rights and obligations when processing your personal data, you also have certain rights when your personal data are processed. These rights include:
Right of access
Simply put, you have the right to know what data we process about you, for what purpose, for how long, where we obtain your personal data, to whom we pass it on, who else processes it and what other rights you have in connection with the processing of your personal data. You can find all this in this document. However, if you are not sure which personal data we process about you, you can ask us to confirm whether or not we process personal data concerning you, and if we do, you have the right to access this personal data. As part of the right of access, you can ask us for a copy of the processed personal data; we will provide the first copy free of charge and further copies for a fee.
Right to rectification
To err is human. If you find that the personal data we process about you are inaccurate or incomplete, you have the right to have them corrected or completed without undue delay.
Right to erasure
In some cases, you have the right to have your personal data erased. We will erase your personal data without undue delay if one of the following reasons applies:
- we no longer need your personal data for the purposes for which we processed them;
- you withdraw your consent to the processing of personal data, the data are data for whose processing your consent is necessary, and we have no other reason to keep processing them;
- you exercise your right to object to processing (see the section Right to object to processing below) for personal data that we process on the basis of our legitimate interests, and we find that we no longer have any legitimate interests justifying this processing, or you believe that our processing of personal data is no longer in accordance with generally binding regulations.
Please keep in mind, however, that even if one of these reasons applies, it does not mean that we will immediately delete all your personal data. This right does not apply if the processing of your personal data is still necessary to fulfil our legal obligation or to establish, exercise or defend our legal claims (see the section Why do we process personal data and what entitles us to do so?).
Right to restriction of processing
In some cases, in addition to the right to erasure, you can exercise the right to restriction of processing of personal data. This right allows you in certain cases to ask for your personal data to be marked and not to be subject to any further processing operations – in this case not forever (as with the right to erasure), but for a limited time. We must restrict the processing of personal data when:
- you contest the accuracy of the personal data, until we agree which data are correct;
- we process your personal data without a sufficient legal basis (e.g. beyond what we have to process), but you prefer only restriction of such data to their erasure (e.g. if you expect that you would give us such data in the future anyway);
- we no longer need your personal data for the purposes of processing described above, but you require them for the establishment, exercise or defence of your legal claims, or
- you object to the processing. The right to object is described in more detail below in the section Right to object to processing. While we investigate whether your objection is justified, we must restrict the processing of your personal data.
Right to portability
You have the right to obtain from us all your personal data that you have given us yourself and that we process on the basis of your consent and on the basis of the performance of a contract. We will provide your personal data in a structured, commonly used and machine-readable format. So that we can easily transfer the data at your request, this can only be data that we process automatically in our electronic databases.
Right to object to processing
You have the right to object to the processing of personal data that takes place on the basis of our legitimate interest (see the section Why do we process personal data and what entitles us to do so?). If it concerns marketing activities, we will stop processing your personal data without further ado; in other cases we will do so unless we have compelling legitimate grounds to continue such processing.
Right to lodge a complaint
Exercising your rights in the way described above does not affect your right to lodge a complaint with the competent supervisory authority. You can exercise this right in particular if you believe that we process your personal data unlawfully or in breach of generally binding legal regulations. You can lodge a complaint about our processing of personal data with the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Prague 7, Czech Republic.
How can you exercise your rights?
Just call us and we will help you fill in the forms.
We will handle your request without undue delay, but no later than within one month. In exceptional cases, in particular due to the complexity of your request, we are entitled to extend this period by another two months. We will of course inform you about any such extension and the reasons for it.
Data protection officer
Given the size of our company, we are not required to have a data protection officer. However, if you have any questions, you can use the phone number on our website or write to gdpr@realsim.cz
The Czech version of this document is binding.
